Terms and Conditions

Mextogen IT Pvt Ltd (“MEXTOGEN”, “we”, “us”, or “our”), a company registered in Delhi, India, owns and operates mextogen.com (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, including purchases of digital products, services, blog content, and all related interactions.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be 18 years or older to use the Site. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Site Usage

Permitted Use:
You may use the Site to browse products, read blogs, contact us, and make purchases.

Prohibited Use:

Copying, reproducing, or distributing content without permission
Reverse engineering products or services
Using automated tools (scrapers, bots) to extract data
Posting harmful, illegal, or infringing content
Interfering with Site functionality

We reserve the right to suspend or terminate access for violations.

3. Digital Products

License Grant:
Purchased digital products (templates, UI kits, motion files) come with a non-exclusive, non-transferable, commercial-use license for one business/entity. You may:

Use in client projects
Modify and customize
Distribute end-products to customers

You may not:

Resell or redistribute original files
Use in competing template marketplaces
Share download links or license keys
Transfer license to another business

File Access: 5 downloads per purchase, links expire in 30 days.

4. Custom Services

Project Scope: Defined in writing (email/proposal/contract). Changes require mutual agreement and may incur extra charges.

Revisions: 2 major rounds included. Additional rounds: ₹5,000/hour.

Ownership: You own final deliverables upon full payment. We retain right to showcase in portfolio (anonymized if requested).

Cancellation: See Refunds and Cancellations Policy.

5. Payments

All prices in INR (₹), GST applicable
Processed via WooCommerce + third-party gateways (Razorpay/Stripe)
Full payment required before final delivery
Late payments: 1.5% monthly interest
All sales final except as per refund policy

6. Intellectual Property

Our Rights: All Site content (text, images, designs, code) is owned by Mextogen IT Pvt Ltd or licensed to us. Protected by Indian copyright laws.

Your Content: By submitting content (inquiries, feedback), you grant us a worldwide, royalty-free license to use it for marketing/portfolio.

7. Third-Party Services

We integrate tools like:

WooCommerce (eCommerce)
Google Analytics (tracking)
Canva/Figma (templates)
Payment gateways (Razorpay/Stripe)

Their terms apply to respective services.

8. Limitation of Liability

To the fullest extent permitted by law:

Site and products provided “as is” without warranties
Not liable for indirect damages (lost profits, data loss)
Total liability capped at purchase amount
Not responsible for third-party tool failures

9. Termination

We may suspend/terminate access immediately for:

Payment issues
Policy violations
Legal requirements

10. Governing Law

These Terms governed by laws of India. Disputes resolved in courts of Delhi.

11. Force Majeure

Not liable for delays due to events beyond control (internet outages, natural disasters, government actions).

12. Severability

If any provision is invalid, remaining terms remain enforceable.

13. Waiver

No waiver unless in writing. Single failure to enforce doesn’t waive future rights.

14. Assignment

We may assign these Terms. You may not without our consent.

15. Entire Agreement

These Terms + Privacy Policy + specific product licenses constitute complete agreement.

16. Changes to Terms

We may update Terms. Changes posted here with “Last Updated” date. Continued use = acceptance.
